    Wat willen bedrijven nu ècht? Global Pound Conferences: Een wereldwijde zoektocht naar de sleutel tot het optimale geschiloplossingsaanbod. Manon Schonewille, januari 2017. 

    Global Pound Conference. Het bedrijfsleven zet mediation en andere vormen van geschilbeslechting nog lang niet in volle potentie in. Waar ligt dat aan? Aan de gebruikers, die nog niet goed weten hoe ze mediation moeten inzetten of er geen interesse in hebben?Aan de externe juristen die zaken liever juridisch oplossen? Of aan de aanbieders die niet goed bij de vraag aansluiten?  

    De Global Pound Conference (GPC) die op 1 juni 2017 in Amsterdam plaatsvindt gaat in op deze vragen.De GPC is niet alleen een congres, maar ook onderdeel van een wereldwijd onderzoek, bedoeld om in de toekomst het aanbod van zakelijke geschilbeslechting beter af te stemmen op de behoeften van de gebruikers.

  • Grensoverschrijdende mediation: hetzelfde, maar dan anders …, M.A. Schonewille in: Ondernemingsrecht 2016/1/11, Wolters-Kluwer, Deventer. 

    Bedoeld voor partijen en partij-adviseurs in een cross-border mediation. Anders dan u wellicht denkt behelst een grensoverschrijdende mediation meer dan ‘gewoon mediation, maar dan in het Engels’. Mediation is voor bedrijven die internationaal zakendoen een goede optie om juridische en zakelijke risico’s te beperken en het is belangrijk om daarbij goed beslagen ten ijs te komen. Uitdagingen in cross-border mediation kunnen zitten in verschillende verwachtingen die partijen hebben over wat een mediation inhoudt, wie daaraan deel moeten nemen, in welk land de mediation gaat plaatsvinden, wat de voertaal is en welk recht van toepassing is op de mediationprocedure. Als dergelijke punten niet vooraf worden geïdentificeerd kan de mediationprocedure zelf aanleiding zijn tot het ontstaan van een nieuw geschilpunt met alle gevolgen van dien. In deze bijdrage krijgt u aan de hand van een casus over een internationaal contractenrechtelijk geschil een overzicht van de mogelijke valkuilen en vooral tips waar u bij een grensoverschrijdende mediation op moet letten.

    Bedoeld voor mediators die grensoverschrijdende mediations begeleiden. Het succesvol begeleiden van cross-border mediations vraagt van een mediator in vergelijking met mediations binnen de Nederlandse grenzen meer voorbereiding en meer flexibiliteit. Manon Schonewille en Peter Kamminga laten aan de hand van een casus uitgebreid de uitdagingen zien waar je mee te maken krijgt wanneer je medieert tussen verschillende culturen en rechtsgebieden.

    Contrary to what you might think, cross-border mediation is more than ‘ordinary mediation, only in English, with partners from different countries’. For businesses that operate internationally, mediation is a good way to limit legal and business risks and it is important to be well prepared for it. Challenges in cross-border mediation may lie in the different expectations the parties have about what mediation entails, who takes part in it, in which country it will take place, in which language it will be conducted and what law will apply to the mediation proceedings. If points like this are not identified beforehand, the mediation process itself may give rise to a new dispute with all the associated consequences. Drawing examples from a (fictitious) international case2 involving contract law, this article presents an overview of the possible pitfalls and above all provides tips about what you should be aware of with regard to cross-border mediation.
