Mastering Commercial Mediation (120 hour program)

 

Mastering Commercial Mediation: Complete 120-hour education to become an internationally recognized mediator with a specialization in workplace, partnership, intracompany and business-to-business disputes (“commercial mediation”). This training may be coupled with an additional assessment to become an internationally qualified IMI Mediator.

Learn from leading mediators

This training offers the opportunity to learn from peer-recognized opinion leaders and practitioners of commercial mediation through a combination of online theoretical and practical classes, as well as face-to-face seminars.  All classes are taught by highly experienced commercial mediators and lead trainers who invite other (international and domestic) mediators, guest teachers and training actors to participate as guest trainers. These lead trainers each have more than 20 years of practical commercial mediation experience. They are active members of IMI and have been ranked for several years in a row as leading professionals by WHO’S WHO LEGAL.  The training is a structured course designed both for new and experienced mediators, and people interested in knowing more about mediation and facilitated negotiations.  Whether to start your own business practice as a commercial mediator or to deepen or broaden an existing mediation practice, or to obtain new insights, tools and techniques about when, how and where to use mediation, the course is designed to provide opportunities for personal professional development for all participants. Highest international standards

This course meets rigorous standards in international certification training and has been recognized as Certified Mediator Training Program (CMTP) by IMI as well as  the Swiss Chamber of Commercial Mediators (SCCM) (a member of the Federation of Swiss Mediators (FSM)) and Mediatorsfederatie Nederland (MfN), the Dutch mediators’ federation, which audits and regulates mediation in the Netherlands and teaching processes in accordance with European Union and Dutch standards.





    

A 120-hour program available in 3 complementary modules

The program consists of three modules that can be taken separately or together.  The full course provides a comprehensive 120-hour training program for mastering commercial mediation.  It is designed for a broad range of professionals, ranging from those seeking to learn and familiarize themselves with commercial mediation, those seeking to hire and work with mediators, and experienced mediators seeking to deepen or expand their practice.  It provides insights into different forms and styles of mediation (e.g., facilitative mediation, transformational mediation, evaluative mediation and conciliation), and also mixed modes of Appropriate Dispute Resolution (ADR) and process design for using mediation in conjunction with litigation and/or arbitration, whether in domestic, cross-border or cross-cultural disputes.  The program also focuses on mediation advocacy, ODR (Online Dispute Resolution), complex and challenging disputes, and recent finding in brain and social sciences and how they may be applied to commercial mediation.

 

Accreditation and (inter)national recognition and certification

After successfully completing Modules 1 and/or 2, and passing a performance-based assessment, you can register as IMI Qualified Mediator. All 3 modules together provide a 120 hours of mediation training certificate that is necessary to be recognized as a commercial mediator by the SCCM and certain cantons in Switzerland and to be certified as having a specialization in commercial mediation.

Module 1: Become a qualified commercial mediator and effective negotiator (55 hours ONLINE)

This is the basic introduction program, essential for beginners but also recommended for lawyers, business executives seeking to improve their negotiation skills and when to use mediation, as well as experienced mediators having a domestic or national mediation practice or wishing to gain new insights into different approaches to commercial mediation.

  • 55 hours online + home study and practical assignments.
  • This module is accredited by IMI, as a CMTP on its own, and can lead to international certification as an IMI Qualified Mediator.
  • Dates of next training for this Module 1: mid-February – end of April 2021
  • The course is divided into 10 sessions, most of which are ½ day sessions of 5 hours each and 2 full day training sessions of 8 hours. In addition to this there is 2 hour introductory class and an individual coaching session of 20-30 minutes with one of the trainers. Participants are also offered to join in an additional voluntary bonus class to pick up on any special topic of interests.
  • Price:

Module 2:  Mastering Business Mediation (55 hours ONLINE)


This is a specialization module to become an accredited commercial mediator and to learn different practical tools and techniques for resolving workplace, partnership, intracompany and business-to-business disputes, whether in a domestic, intercultural, international or ODR settings.

  • 55 hours online + home study and separate practical assignments and preparatory sessions with disputants; this emphasis of this module is on mediation practice through role-plays online (including use of intake meetings, joint sessions, caucuses, and co-mediation).
  • This module is accredited by SCCM as a specialized module on commercial mediation and can lead to recognition as a specialized commercial mediator, as well as to international certification as an IMI Qualified Mediator.
  • This module is particularly suited to new and experienced mediators wishing to specialize in commercial mediation, whether to learn new techniques for workplace conflicts (e.g., Toolkit’s TEAM-FIX 4-hour rapid intervention tool), or to diagnose, adapt and design appropriate interventions in complex or highly charged commercial cases involving domestic, international or cross-cultural disputants. This module is also recommended for business executives, lawyers and other advisors or negotiation professionals who wish to learn how to initiate commercial mediations, select neutrals, design bespoke processes and prepare for or successfully participate in workplace or commercial mediations.

  • The course is divided into 10 sessions, most of which are ½ day sessions of 5 hours each, and 2 full day training sessions. In addition to  this there is 2 hour introductory class.

Module 3:  Advanced Practice and roleplaying specialization course, Mastering Mediation in practice (10 hours ONLINE or 17 hours IN PERSON)

This is an intense practical session for students having taken Modules 1 or 2 or for experienced mediators wishing to try out new techniques in a safe simulation environment that provides peer and participant feedback.  The module involves role plays to test advanced practices (e.g., co-mediations, complex disputes, multi-party disputes, etc.).  It is also an opportunity for self-reflection, using Toolkit’s 5-step intervision process.

  • 10 hours (two 5-hour sessions) online or 17 hours (two full days) in person (usually in Geneva, Switzerland) + separate preparatory sessions with disputants and/or co-mediators.
  • This module is accredited by SCCM as a specialized intervision and advanced practice module.  It is required for a full SCCM mediation accreditation by Toolkit.
  • This is an intense 2-day training fully based on role plays, intended to provide practical experience and an opportunity to test out advanced practices in challenging situations, such as breaking through deadlocks or impasses, and dealing with practical dilemmas and strategic choices.
  • Dates of next training(s) for this Module 3: September – November 2021  (It may be offered twice, depending on participant interest: once online and once in person, with different cases to test different advanced practices)

Optional additional IMI Qualified assessment program (ONLINE or in person in The Netherlands)

  •  This is an optional three-step program:
    1. Post training assessment to become an IMI Qualified Mediator
    2. Gaining practical experience
    3. Oral assessment reviewing your practice experiences to become an IMI Certified Mediator.
  • The post training performance-based assessment (step 1) consists of 1½ hours, including 45 minutes of mediation with 2 professional training actors as the disputants and 2 assessors. You will receive written feedback on your performance and if you pass the assessment you can register with the International Mediation Institute as IMI Qualified Mediator.
  • Once you have acquired actual mediation experience (20 cases or 120 hours in step 2) you are qualified to become an IMI Certified Mediator after an oral assessment reviewing your practice experiences (step 3) and to be recognized by the International Mediation Institute and over 110 associated international mediation bodies across 5 continents.
  • For IMI Certification (step 3) you will need to obtain feedback from the participants in your mediations, which will be summarized in a feedback digest by a peer reviewer.  For completing the three steps to your certification you are also requested to generating your mediation logbook and finding a peer reviewer. Toolkit Company will help you to subsequently organize a 20-minute interview to present and discuss your actual mediation cases with an assessor.
  • Dates: This assessment can be taken after Modules 1, 2 or 3 and will be offered several times throughout the year.

o   IMI Qualified Assessment (step 1): € 1.050,00/CHF 1.150,00, (not including VAT, if applicable).  Members of the SCCM or CCIG or Toolkit Alumni benefit from a reduced rate of € 925,00/CHF 999,00 (not including VAT, if applicable).

o   Step 3, a 20-minute interview with an assessor to review your practice experience, to become IMI Certified Mediator: € 395,00/CHF439,00.
